Brick Stores – Annual membership fee on “Buy now, pay later” type financing plans

On November 5, 2009, we filed a motion for authorization to institute a class action against The Brick Warehouse LP, a retailer of home furnishings, appliances, electronics and mattresses, doing business in Quebec under the name of Brick.

We criticized the retailer for luring customers with slogans such as “pay nothing for 15 months” and “no money down, no monthly payments, no interest.” In fact, the consumers who subscribed to its financing plan had to pay an “annual fee” of $35.


Anyone who, in Quebec, has subscribed to a financing plan for the purchase of goods in a Brick store and was charged an annual membership fee or any equivalent charges.


A settlement has been reached between Brick and Option consommateurs. On November 27 2012, the Honorable Louis Crête of Quebec Superior Court approved the settlement. Brick was to pay the class members more than $2 millions.

A first distribution of over 1,9 million dollars occurred. But it was later discovered that The Bick omitted to include some class members so they were not compensated. Other class members were compensated but did not receive the full amount they were entitled to.


Where we are now
We concluded a new agreement with The Brick in order to allow the omitted class members to receive the same benefits provided by the first agreement and to compensate some of the members who did not receive the full amount they were entitled to. On September 2nd, 2016, Quebec Superior Court approved this agreement.


To file your claim
For the members who subscribed to the financing plans before May 1st, 2009: The Brick has already sent out cheques by mail to those who were partially refunded, after updating their address with the Canada Post National Change of Address Data. This part of the process is now over.


You have been forgotten during the first distribution?

For the members who subscribed to the financing plans between May 1st, 2009 and April 30, 2010: you must complete the claim form The Brick will send you and send it back through mail to Option consommateurs or fill out the online claim form, available at www.brickclassaction.com. In order to fill out the online claim form, you will need to use the code on the claim form that you will receive by mail.

The deadline to submit your claim is December 18, 2016

No claim will be accepted after this date. 

You will be informed of the results of processing your claim by mail in March 2017.
