Bill C-27 - Digital Charter Implementation Act, 2022

By rewriting the Personal Information Protection and Electronic Documents Act to adapt it to the digital context of the 21st century, Bill C-27 has a laudable objective. However, Option consommateurs is concerned that the new version of the Act will not effectively protect Canadian consumers.

Our analysis of Bill C-27 is in two parts.

  • First, we outline how the legislation lacks teeth, proving insufficiently dissuasive and posing significant threats to consumers' ability to enforce their rights against businesses (Part 1).
  • Secondly, we propose several improvements to the bill's content to better protect consumer privacy, notably by improving the framework for protecting children and strengthening consumer control over their personal information (Part 2).

Option consommateurs supports the broad guidelines proposed by the Commission d'accès à l'information regarding the interpretation of the criteria for valid consent in the new version of the Loi sur la protection des renseignements personnels dans le secteur privé.
