POLYURETHANE FOAM - PRICING

On October 28, 2010, Karine Robillard filed a motion for authorization to institute a class action against several polyurethane foam manufacturers.

We accuse these companies of having conspired with each other (and with other competing companies), since January 1, 1999, to artificially fix the price of polyurethane foam across North America.

The alleged acts contravene the Competition Act and caused consumers to overpay by thousands of dollars.

This class action aims to compensate them.

Polyurethane foam can be found in a multitude of products such as carpet pad and upholstery for sofas, chairs, mattresses and more.

 

We should mention that :

  • The allegations against the manufacturers were revealed by an investigation conducted by the Canadian Competition Bureau;
  • The Canadian polyurethane foam market is controlled by six major manufacturers: Domfoam, Valle Foam, Woodbridge, Foamextra, Groupe Vitafoam and Groupe Carpenter. These companies control 80% of the Canadian polyurethane foam market;
  • on January 5, 2012, Domfoam and Valle Foam pleaded guilty to conspiracy charges under the Competition Act and were ordered to pay fines totaling $12,500,000 as a result of their involvement in the cartel (Read the Competition Bureau press release, January 6, 2012).

 

Our members

The group includes any person, company or association with 50 or fewer employees who, between January 1, 1999 and August 1, 2010, purchased polyurethane foam or a product containing it in Quebec.

Where we are

On July 18, 2012, the Quebec Superior Court authorized Option consommateurs and Karine Robillard to become plaintiffs and also to sue Carpenter Canada, Carpenter Co, A-Z Sponge & Foam Products, Domfoam International, Valle Foam Industries (1995), Future Foam Inc, Flexible Foam Products Inc, Les Industries Foamextra, Leggett & Platt Inc, Mohawk Industries Inc, Hickory Springs Manufacturing Company and Woodbridge Foam Company.
