Option consommateurs c. Samsung (washing machines)

Description

In October 2016, Ms. Chantal Gagnon filed an application for authorization to proceed class action against Samsung Electronics Canada Inc, Samsung Electronics Co. Ltd and Sears Canada, accusing them of manufacturing, marketing and selling defective top-loading washing machines that are liable to explode. 

When using certain cycles, the cover of these machines may suddenly come off, causing damage to the vicinity of the unit and possibly injury to persons.

Option consommateurs and Ms. Gagnon also criticizes them for implementing a recall process that neither solves the problem nor adequately compensates consumers.

class action seeks reimbursement of the washer's purchase price and incidental costs, as well as damages and punitive damages.

Option consommateurs and Mrs. Gagnon are represented by the firm Belleau Lapointe.

 

Our members

You are a member of the group if you have purchased, in Quebec, one of the following models of top-loading washing machines: The following Samsung top-loading models, manufactured from March 2011 to April 2016:

WA5471ABP/XAA, WA5451ANW/XAA, WA5451ANP/XAA, WA422PRHDWR/AA, WA456DRHDSU/AA, WA456DRHDWR/AA, WA50F9A8DSP/A2, WA45H7200AP/A2, WA45H7200AW/A2, WA45H7000AW/A2, WA48J7770AW/A2, WA52J8700AP/A2.

The following Samsung top-loading washer models manufactured from March 2011 to June 2016:

WA40J3000AW/A2, WA56H9000AP/A2.

The following Samsung top-loading washer models, manufactured from March 2011 to October 2016:

WA50K8600AV/A2, WA45K7600AW/A2.

The following Kenmore top-loading washer models, manufactured from March 2011 to April 2016:

592-29212, 592-29222, 592-29227, 592-29336.

Note: Having benefited from Samsung's recall campaign does not prevent you from being a member of the group.

Where we are

On April 26, 2018, the Superior Court authorized Option consommateurs to exercise this class action against Samsung.

Proceedings against Sears are suspended.

If you've purchased one of the Samsung or Kenmore washers covered by class action, you're automatically a member of the group, even if you made your purchase at Sears.
