NOTICE OF CLASS ACTION

AUTHORIZED BY THE SUPERIOR COURT OF QUEBEC

You may be a member of this class action

 

This notice concerns a class action initiated by Option consommateurs against Pharmaprix, Shoppers Drug Mart, Shoppers Drug Mart Corporation and 911979 Alberta Ltd. regarding changes made to the Optimum loyalty program on July 1, 2010. Option consommateurs believes that these companies did not have the right to unilaterally reduce the value of Optimum program points. The class action seeks to compensate class members for the loss in value of their Optimum points, and to restore the points scale in effect on June 30, 2010.

 

On March 9, 2012, the Superior Court authorized Option consommateurs to initiate a class action against these companies.

 

This judgment may affect your rights, whether you act or not. Please read this notice carefully.

 

Who's a member?

You are a member of this class action if :

- On June 30, 2010, you were a member of the Pharmaprix Optimum program;

AND

- You are a Quebec resident.

 

What are your rights?

What do you have to do to participate in this appeal?

If you are a member of the group and agree with the purpose of the lawsuit against the companies being sued, you don't have to do anything to participate in this action.

You may opt out of the class if you do not wish to be bound by the class action against Pharmaprix and Shoppers Drug Mart.

 

How to exclude yourself from the group?

To exclude yourself, you must notify the Clerk of the Superior Court in writing by sending a letter indicating :

- file number: 500-06-000517-108 ;

- your name, address and telephone number ;

- your declaration: i am a class member and wish to opt out of the class action ;

- your signature.

 

You must send your letter by registered or certified mail before July 19, 2012 to the following address:

Description

On December 21, 2010, Option consommateurs joined the class action brought by Mr. Pierre Gaumond against Pharmaprix Inc, Shoppers Drug Mart Inc, Shoppers Drug Mart Corporation, 911979 Alberta Ltd and Shoppers Drug Mart (London) Limited on behalf of members of the Optimum loyalty program.

 

We accuse Pharmaprix Inc, Shoppers Drug Mart Inc, Shoppers Drug Mart Corporation, 911979 Alberta Ltd and Shoppers Drug Mart (London) Limited of unilaterally reducing the value of the points they gave to class members in exchange for their loyalty.

 

Prior to July 1, 2010, the terms and conditions of the Optimum program provided for the following point exchanges:

On July 1, 2010, the respondents unilaterally modified the value of the exchanges as follows:

By modifying the points value scale downwards, Pharmaprix inc., Shoppers Drug Mart inc. and Shoppers Drug Mart (London) Limited are unilaterally and retroactively modifying a contract whose terms cannot be negotiated, thereby causing damage to consumers.

 

 

Our members

All persons who, on June 30, 2010, were members of the Pharmaprix Optimum program AND resided in Quebec are members of this class action.

 

Where we are

On March 9, 2012, the Quebec Superior Court authorized the class action against Pharmaprix.
