Option consommateurs c. MinebeaMitsumi and NSK ltd (ball bearings)
Description
In 2015, Option consommateurs sought authorization to exercise a class action against several companies that manufacture small ball bearings. On August 4, 2016, the Superior Court authorized the exercise of this class action and allowed Option consommateurs to represent the members of the group.
These companies are accused of having conspired between June1, 2003 and October 31, 2011 to reduce competition and artificially fix the price of small ball bearings. The alleged acts contravened the Competition Act and led consumers to pay too much for the purchase of these ball bearings or products containing them. class action is intended to compensate consumers.
Small ball bearings are those with an outside diameter of 26 millimeters or less. This type of ball bearing is found in many everyday products, including telecommunications equipment, household electrical appliances, video cameras, office equipment, personal computers, air conditioners, fishing reels and power tools.

Is a member ofclass action any person who has purchased in Quebec one or more ball bearings with an outside diameter of twenty-six millimeters or less or one or more products equipped with one or more ball bearings with an outside diameter of twenty-six millimeters or less between June 1, 2003 and October 31, 2011."
Where we are
A national settlement has been reached with the defendant Minebeamitsumi Inc (formerly Minebea Co.). The settlement summarily provides for payment by Minebeamitsumi of $1,500,000.00 to Canadian class members in exchange for a release.
A settlement agreement between Option consommateurs and NSK Ltd. and NSK Canada Inc. was reached on December 17, 2020 and approved by the Court on May 18, 2022.
